THEORETICAL AND APPLIED ANALYSIS OF CRIME PREVENTION AS A GOAL OF CRIMINAL PUNISHMENT

Annotation:

The article discusses the theoretical foundations of the implementation of one of the goals of punishment, namely the prevention of crimes. The philosophical and historical premises of the definition of this purpose of punishment are analyzed, as well as the effectiveness of the modern system of criminal penalties and the practice of their appointment in terms of achieving the goal of crime prevention. Attention is focused on the low efficiency of crime prevention on the part of the convicted person (special warning) based on the indicator of the level of recidivism of crimes. It is stated that the reason may be the imperfection of sanctions: their inconsistency with the severity of the crime committed, as well as (quite often) excessive alternativism of punishments provided for the commission of a specific crime.
