Annotation:

The article examines topical problems of bringing to justice persons held in institutions of the penal system under Article 20.3 of the Code of the Russian Federation on Administrative Offenses. The author notes the actual problems in this area, taking into account the specifics of the work of correctional institutions and pretrial detention centers, suggests ways to solve them, gives examples of judicial practice.
The author’s conclusions are based on certain provisions of the research work carried out on the basis of the Kuzbass Institute of the Federal Penitentiary Service of Russia on the topic: «The procedure for bringing suspects, accused, convicted persons held in institutions of the penal system of the Russian Federation to administrative responsibility», carried out at the request of the Chief of the Federal Penitentiary Service of Russia in 2020.
